We require sub-processors to protect personal information through appropriate contractual terms and, where applicable, data transfer mechanisms described in Section 5. The current list of sub-processors, including categories of processing and locations, is published at: https://zylvie.com/subprocessors We may update that list from time to time. Where we act as a processor for sellers, we provide notice of material sub-processor changes as described in our Data Processing Agreement at https://zylvie.com/dpa. 5. INTERNATIONAL DATA TRANSFERS In Short: We are based in the United States and may transfer personal information internationally with appropriate safeguards. Zylvie / Deep Roots Media, LLC is established in the United States. Personal information we collect may be transferred to, stored in, and processed in the United States and other countries where we or our sub-processors operate. Those countries may have data protection laws that differ from the laws of your country. Where required by applicable law (including the EU GDPR, UK GDPR, and Swiss FADP), we implement appropriate safeguards for international transfers, including: * Standard Contractual Clauses. We rely on the European Commission Standard Contractual Clauses (Decision (EU) 2021/914), including Module 2 (controller to processor) and, where applicable, Module 3 (processor to processor), incorporated by reference into our Data Processing Agreement at https://zylvie.com/dpa, with supplementary measures where appropriate. * UK Addendum. These technologies help us keep you signed in, secure the Services, remember preferences, measure performance, and understand how the Services are used. Seller storefronts may use cookies and similar technologies for checkout, analytics, affiliate tracking, and marketing integrations configured by the seller. Where required by law (including GDPR), visitors to those storefronts are presented with cookie consent choices before non-essential cookies are placed, except as needed for strictly necessary operation of the storefront. You can control cookies through your browser settings. If you reject cookies, some features of the Services may not function properly. For interest-based advertising choices on third-party sites, visit http://www.aboutads.info/choices/. 7. SELLERS, BUYERS, AND THE DATA PROCESSING AGREEMENT In Short: If you sell on Zylvie, you control buyer and lead data; we process it for you as a service provider/processor under our DPA. Zylvie provides hosted storefronts, checkout, subscriptions, delivery, affiliates, email, and related tools. When you use Zylvie as a seller: * You are the controller (or "business" under CCPA/CPRA) of personal information about your buyers, leads, affiliates, and other end users who interact with your brands ("Customer Personal Data"), except where Zylvie acts as an independent controller for its own purposes (such as billing your Zylvie account or platform security). * Zylvie acts as your processor/service provider and processes Customer Personal Data only to provide the Services and in accordance with your instructions, our Terms of Use, your account configuration, and our Data Processing Agreement ("DPA") at https://zylvie.com/dpa. * By enabling or continuing to use seller features, including accepting the DPA in your account Settings (or by using the Services after notice of the DPA), you agree to the DPA terms, including authorization for sub-processors listed at https://zylvie.com/subprocessors. If you are a buyer or lead on a seller's storefront, the seller's privacy policy (if any) and practices apply to how they use your information after they receive it from Zylvie. Zylvie processes your information to complete transactions, prevent fraud, provide support, and operate the platform as described in this notice. Payment information you provide at checkout is transmitted to the applicable payment provider (Stripe, PayPal, Paddle, or others enabled by the seller). Those providers process payment data under their own privacy policies. Zylvie receives limited payment metadata (such as transaction IDs and status) needed to operate orders and subscriptions. 8. HOW DO WE HANDLE YOUR SOCIAL LOGINS? In Short: If you choose to register or log in to our services using a social media account, we may have access to certain information about you. We will use the information we receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the relevant Website. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps. 9. HOW LONG DO WE KEEP YOUR INFORMATION? In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law. We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When you close a seller or buyer account, we delete or anonymize active account data within a reasonable period, typically within one (1) month after termination, subject to backup retention and legal holds. Customer Personal Data processed on behalf of sellers is retained according to the DPA and the seller's account status. Sellers may export or request deletion of Customer Personal Data through the Services or by contacting privacy@zylvie.com. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. 10. HOW DO WE KEEP YOUR INFORMATION SAFE? In Short: We aim to protect your personal information through a system of organizational and technical security measures. We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.
